The city of Berkeley, California is known for its progressive values, diverse community, academic achievement, and political activism, primarily due to the presence of the University of California, Berkeley. Surprisingly, then, the Berkeley Unified School District has become the center of a federal civil rights complaint submitted to the U.S. Department of Education by the Brandeis Center for Human Rights Under Law and the Anti-Defamation League. This action was initiated in response to allegations of a hostile environment for Jewish students at Berkeley High School, following an attack by Hamas on Israel on October 7.

In the aftermath of the attack, a 14-year-old student, who is both Black and Jewish, faced an increasingly hostile atmosphere at school. His mother, a 38-year-old midwife, noticed a troubling shift in her son’s behavior, as he began to hide his Jewish identity due to the negative sentiment surrounding it at his school.

The student’s experiences included exposure to provocative “resistance art” by his art teacher, which included offensive imagery against the Jewish community including a fist being punched through a Star of David. Additionally, classroom decorations and materials promoting a walkout and displaying the Palestinian death toll further exacerbated the situation, signaling a growing intolerance towards Jewish students.

Matters escalated when the student’s peers participated in a school walkout, during which some students were heard chanting phrases advocating violence against Jews. This incident highlighted the severe level of harassment Jewish students were facing within the school community.

In many ways, the school district administrators are hamstrung by unionized labor negotiations protecting the rights of teachers vis a vis students. Protections of personal expressions are part of labor negotiations with one of the most powerful labor union groups in the country.
